Maximum Rewards® General Program Terms and Conditions:  Please read these terms and conditions for important information about the Maximum Rewards® Program, hereafter being called “the Program”.  First Bankcard, a division of First National Bank of Omaha (referred to herein as “we”, “us”, “our”, and “First Bankcard”) is the issuer of your Visa® credit card account (“Account”) and the sponsor of the Program.  As used in these terms and conditions, the words “you” and “your” means owner(s) and authorized users of Account(s) enrolled in the Program.  SHC Direct, L.L.C. (“SHC Direct”) manages the merchandise and gift card/certificate portions of the Program and Loyalty Innovations, a division of Travel and Transport, Inc.  (“Loyalty Innovations”) manages the travel portion of the Program.  SHC and Loyalty Innovations are solely responsible for managing the redemption portions of the Program and may impose additional conditions, restrictions and limitations on your redemptions.  We are not responsible for SHC and/or Loyalty Innovations’ products, services or decisions or their refusal to honor redemptions or to otherwise participate in the Program. 

These terms and conditions are in addition to those set forth in your Cardmember Agreement.  Any changes to these terms and conditions will be posted on the Website (as defined below), and it is your responsibility to review the Website to learn of any such changes in these terms and conditions.  Your Cardmember Agreement remains in full force and effect and is unaffected by these terms and conditions. 

1. Enrollment; Participation.  The Program is offered at our sole discretion.  There is no cost to enroll in the Program.  Your enrollment in the Program may occur automatically when you receive your Visa credit card we issue to you upon the opening of your Account or at a later time when you are invited to participate in the Program.  To participate in the Program, you must reside in the United States and your Account must be open and in good standing (as defined by us from time to time).  Points cannot be earned or redeemed and any accumulated points may be forfeited immediately if your Account is not in good standing. Examples of an account not in good standing include, but are not limited to, an overlimit account, a delinquent account or an account otherwise in violation of your Cardmember Agreement.

2. Points.  We will award you one point for each one dollar in Qualifying Credit Card Transactions posted to your Account (only on or after the effective date of your enrollment in the Program).  “Qualifying Credit Card Transactions” means authorized new purchases posted to your Account, net of refunds, credits (for returned merchandise or otherwise) and disputed billing items (alternatively, points may be deducted for awards based on purchases that are subsequently subject to a refund, credit or dispute).   “Qualifying Credit Card Transactions” do not include: (a) annual fees, finance charges and other fees or charges posted to your Account, (b) cash advances or special check transactions, (c) balance transfers, (d) charges for other products, services or benefits that we provide (such as credit insurance premiums), or (e) other transactions that we determine in our sole discretion not to be eligible for Qualifying Credit Card Transactions treatment. 

We may award you one or more additional bonus points, at our sole discretion, in connection with certain transactions and/or promotions (details will be provided with such offers).  Points are redeemed on a “first in/first out” basis, so that the first points you earn will be the first points redeemed.  Points will expire on or after the fifth anniversary of when they were awarded.  There is no limit to the number of points that you can earn; provided, however, there may be a limit to the number of bonus points that you can earn in connection with certain transactions and/or promotions.

You can receive information regarding your Account (including the number of points earned and redeemed) by going to the Website (as defined below) or calling the Maximum Rewards® Call Center.  In addition, your Account billing statement will include your total number of points earned for the then current billing cycle.
 
3. Point Purchase.  By calling the Maximum Rewards® Call Center you can purchase extra points in 1,000 point increments for $20 per 1,000 points which will be billed directly to your Account.  Any points purchased are subject to these terms and conditions, including those of point forfeiture.  Point purchases are final upon our authorization and cannot be reversed.

4. Point Discrepancies.  Point awards are not made until they show on your Account statement and we reserve the right to retroactively correct errors made in point awards.  If you think there is a discrepancy in your points, you must notify us within 60 days of the date of the first statement which shows the discrepancy.  If you fail to notify us, your statement will be considered accurate, and you will have waived all claims for adjustment.  In the event that an adjustment to your point total means that you received a reward that you were not otherwise entitled to under the Program, you agree that you owe us the point value of such excess redemption and that we have the right in our sole discretion to reduce your points accordingly, withhold any subsequent points and/or Rewards you earn that correspond(s) in number to any you received in error, and collect any such amount you owe.  Point discrepancies do not constitute billing errors on your Account and payments on your Account are due as provided in your Cardmember Agreement.

5. Additional Restrictions. You may not accumulate points in connection with transactions made in violation of law or your Cardmember Agreement.  You may not combine purchases or points from, or transfer points to, another account.  Points cannot be used for credit on your Account, nor will any accommodation be made for unused, forfeited, discontinued or expired points.  If you fail to pay your Account on time or otherwise fail to follow the terms of your Cardmember Agreement, you will forfeit accumulated points.  Except for the cash rebate option, points have no cash value, are non-negotiable, and cannot be redeemed either in whole or in part for cash.  Points do not constitute your property.  The sale or barter of points is prohibited and will void your points.  Points are not transferable in the event of death, as part of a domestic relations matter, or for any other reason.  We are not responsible and bear no liability for any disputes concerning the ownership, redemption or disposition of any points.

6.  Disqualification; Termination.  We reserve the right to disqualify any person and/or Account from participation in the Program, refuse to award or redeem points, or close your Account if, in our sole judgment, your Account is not in good standing, you have provided false information or you or any other person using your Account has violated any of the terms, conditions, and/or purpose of the Account and/or the Program, including, but not limited to, fraud, excessive transactions, or other abuse.  Such disqualification may be temporary or permanent and result in the forfeiture of any accumulated points.  Closing your Account (by you or by us) will result in the termination of your enrollment in the Program.  We reserve the right to suspend, cancel or terminate the Program, in whole or in part, for any reason, at any time and to amend the terms and conditions of the Program at any time.  Our decisions regarding the Program are final.  If we suspend, cancel or terminate the Program or your enrollment in it, you may not be awarded any further points and you may lose all points previously awarded.  If the Program is terminated through no fault of your own, you will be notified of the date by which you must redeem all your accumulated points.

7. Changes. We reserve the right to change these terms and conditions or limit, modify, delete or otherwise change any aspect of the Program and its rules, restrictions, benefits or features, in whole or in part, including but not limited to suspending or terminating all or part of the Program, with or without prior notice.  Changes may have a retroactive effect.  Changes may affect outstanding transactions and points, and may include, but are not limited to, the number of points required to earn Rewards, the type of transactions which qualify for points, the type and/or value of Rewards, the availability of Rewards, the addition of blackout dates, the imposition of an annual Program membership fee or the increase of any fee that may be associated with the Program, and the number of points which may be earned or purchased per month or per year.   Changes may affect points that have already been awarded as well as those to be awarded in the future.  We may also substitute another rewards program for this one, in our sole discretion.

8. Release of Information.  You consent to our release of information about you and your Account to third parties (including, but not limited to, SHC Direct and Loyalty Innovations) as necessary or convenient to carry out the Program.  If you withdraw consent, or exercise your opt-out rights under our Privacy Policy, we may disqualify you from the Program, close your Account and, subject to credit approval, establish a substitute account for you (which may or may not have a rewards feature).

9. Taxes.  Determination and payment of any liability for federal, state, or local income taxes regarding the earning or redemption of points is your sole responsibility.  Please consult your tax advisor concerning any income or other tax consequences related to your participation in the Program.

10. Audits.  We reserve the right to audit your Account for compliance with these terms and conditions.  In the event an audit reveals any point or other discrepancies, the awarding of points and the redemption of points for Rewards may be delayed until such discrepancies are resolved.

11. Other Terms.  The Program is void where prohibited by law.  All interpretations of these terms and conditions, all determinations of point discrepancies and the resolution of all other disputes shall be at our sole discretion, and our decisions will be final.  We are not responsible for problems beyond our control, such as, but not limited to, communications or computer systems failures, war or acts of God.  In no event shall we, SHC DIRECT or LOYALTY INNOVATIONS be liable for special, incidental, indirect, consequential or exemplary damages.  By participating in, claiming or accepting any points or other benefits of the Program, you agree to release us, SHC Direct and each of our respective affiliates from any claim or liability relating to the Program or your use of any Reward.  These terms and conditions are governed by and shall be construed in accordance with Nebraska law (excluding conflicts of law principles).

12. Rewards; Redemption.  You can use your points to obtain merchandise, gift cards/certificates, air travel and other goods and services as well as cash back as a credit to your Account (collectively, the “Rewards”).  You may view many of the Rewards available to you in the Rewards catalogue, and upon your request, we will mail you the then current Rewards catalogue.   The complete selection of Rewards is available on the Website.  You can redeem points to obtain Rewards by calling the Maximum Rewards® Call Center or, if you have chosen to have online access to your Account, by visiting your Account online and then clicking the “REWARDS/REDEEM” button, which takes you to the Maximum Rewards® Website (“Website”).  Neither us nor SHC Direct shall have any liability for fulfilling reward requests we believe in good faith are made by any person claiming authority to act on your behalf.  All rewards are subject to availability.  We reserve the right to substitute a Reward of equal or greater value.  We are not responsible for replacing lost, stolen or destroyed Rewards.  There is no redemption fee for merchandise or gift card/certificate Rewards.  A $37.95 redemption fee is applicable for travel within the U.S. (all 50 States), Canada, Mexico and the Caribbean and a $47.95 redemption fee is applicable for international travel.  This fee applies to each ticket issued and each Travel Discount awarded.  Points may be redeemed for a cash rebate option in the form of an Account credit only.  If you have any questions regarding the status of a Reward redemption or any other question, call the Maximum Rewards® Call Center at 888-442-5681.

Travel Rewards (includes Air Travel Rewards, Car Travel Rewards & Hotel Rewards)

A.   Air Travel Rewards (Airline Travel and Travel Discounts).
 
1.   Air Travel Rewards (Airline Travel and Travel Discounts).  You may redeem points on Airline Travel and/or on Travel Discounts.  You may redeem points for a scheduled airline ticket.  Electronic tickets will be issued whenever possible.  Tickets may be purchased in any name designated by you but the tickets and/or itinerary will be mailed to the primary cardmember’s billing address.  Carriers and traveling dates are at your choice, but reservations on some carriers may not be available (e.g. carriers not in the Apollo GDS System, with a record of unreliable service, etc....).  No blackout dates or capacity controls apply.  Web-based pricing and carrier rates may not apply.  All airline travel and travel discounts on tour, package, cruise or airline must be booked through Loyalty Innovations Travel Services using their reservation system.  Tickets for airline award seats are subject to availability and any terms or conditions imposed by the airline.  Passenger facility charges may apply and are your responsibility.  Any International entry or departure taxes and/or all fees and any fees for paper tickets, are at your expense.  Rewards may be subject to local taxes and fees, which are at your expense.  Vacation Rewards are also subject to any restrictions imposed by the travel provider.  If you cancel a package, tour or cruise after deposit is made, First Bankcard  will credit points back to your account only if 100% of the expense incurred by First Bankcard for the points redeemed is returned to First Bankcard by the package, tour or cruise company.  Trip Insurance purchased at your expense is suggested to protect you from loss of points or cancellation penalties.  Miscellaneous costs, including, but not limited to, excess baggage, gratuities, insurance, and airline amenities, are your responsibility.  Additional costs, such as rush charges and/or traceable overnight delivery of Rewards, are at your expense.   

2.    Airline Travel.  Airline Travel redeemed will be applied to the total cost of the airline ticket which will be converted to a corresponding point cost as represented in the airline travel grid posted in the rewards catalog.  Tickets must be "paid for" with points only; a cash and point exchange is not allowed.  If the ticket exceeds the printed grid values, Loyalty Innovations will recalculate the necessary points. 

3.   Travel Discounts.  Travel Discounts redeemed will be applied towards air inclusive, land only, tour, cruise packages or airline.  Full deposit must be made by you unless 100% of the package is covered by redemption of points.  Overages are your responsibility and must be charged to your Account.  Some travel carriers, including, but not limited to, Southwest Airlines, will not accept multiple forms of payment  (i.e., use of both a credit card and a travel discount) for ticket issuance.  Under these circumstances, you may be required to pay for the entire cost of your desired travel by using your credit card. Upon issuance of the ticket by Loyalty Innovations, you will receive reimbursement (in the form of a check from Loyalty Innovations) in the amount of the travel discount. 

ADMINISTRATIVE SERVICES.  Administrative services are provided by and the responsibility of Loyalty Innovations (a subsidiary of Travel and Transport).  First Bankcard assumes no liability or responsibility for the provision of, or failure to provide, the respective services being provided hereunder by Loyalty Innovations and Loyalty Innovations is an independent contractor and is not affiliated with First Bankcard.  First Bankcard may change the provider of administrative services at any time.  None of First Bankcard, Loyalty Innovations nor Travel and Transport shall be liable for any bodily harm and/or property damage, which may result from participating in the Program nor the provision of goods or services by suppliers.

        HOURS OF OPERATION.   Loyalty Innovations hours of operations are Monday – Saturday, 8:00 a.m. to 8:00 p.m. Central Standard Time.  The travel center is closed on New Years Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day and Christmas Day.   Other holiday hours may vary.

B.  Car Travel Rewards. Car rental Rewards are described both in terms of points required and a corresponding Maximum Dollar Value (“MDV”).  Allow 4-6 weeks to receive car rental Rewards.  Once received, advance reservations of at least 7 days are required and are subject to availability. MDV includes tax.  Cannot be combined with any other offer or promotion.  Coupon use must be disclosed at time reservation is made.  You must meet credit, age, and driver requirements in effect at the time and place of rental.
  1. Car Rental subject to availability and black out dates may apply.
  2. Car-rental Certificates may not be combined with any other corporate discount program number, discount or promotional rates or programs.
  3. Taxes, tax reimbursement, local airport fees, customer facility fees ($10/contract in CA for Avis), concession recovery fees, surcharges and optional services—such as refueling, upgrades to higher car classes, extra-day and drop charges, additional driver fee, LDW and optional insurance like PAE, PAI, PEC, SLL and LIS—are the responsibility of the CM for Avis Certificates.
  4. Renter must meet participating rental-car establishment’s standard driver, credit and age qualifications (minimum rental age for Avis is 25; exceptions apply/under 25 surcharge may apply) at time and place of rental.
  5. Vehicles must be returned to renting location except where intercity and intracity drop-offs are permitted by the car-rental company.
  6. Certificates are redeemable for the amount/value indicated on the face of the Certificate and have no cash value.
  7. Certificates must be surrendered at the time of rental, and no reproductions or photocopies of Certificates will be honored.
  8. Renters using Certificates will not earn frequent-traveler miles/credits or points.
  9. Car-rental Certificates cannot be returned for a credit on your credit card or for a redeposit of points into your Program account.
C.  Hotel Rewards.  Hotel Rewards are described both in terms of points required and a corresponding Maximum Dollar Value (“MDV”).  Allow 4-6 weeks to receive hotel Rewards.  Once received, advance reservations of at least 21 days are required and are subject to availability.  The MDV equals the per night rate, including tax, for a standard single- or double-occupancy room.  There is no minimum stay requirement.
